Moskaliuk N. Genetically Modified Products as Objects of Civil Law Relations

The dissertation deals with civil law to obtain scientifically based and reliable results and recommendations for an integrated concept of improving national legislation in the aspect of such new objects in civil relations as genetically modified products, the legal regulation of their turnover. The work focuses on the scientific issues of legal protection of GMP as objects of civil rights, the content of the term "genetically modified products" and the reason of their recognition as the objects of civil rights, also it has been analyzed the development of GMF legal protection. It has been substantiated patentability and exclusion from patentability of the invention, the object of which is genetically modified product, procedures for acquisition of human invention in Ukraine, the object of which is GMP. Considerable attention has been paid to the peculiarities of the GMP utilization. It has been concluded that the introduction of genetically modified products into civil circulation requires obtaining the appropriate permits, and therefore the criterion ability of the turnover can be attributed to objects, which are limited in circulation. It has been also established that in Ukraine it was initiated the adoption of special legislation on genetic engineering, however, it remains the need to introduce stricter rules on GMOs' monitoring
