Stetsyk N. Technology of Judicial Law-making Activity: General Theoretical Characteristics

The thesis is devoted to analysis of general judicial law-making technology. The work is the legal nature of judicial law-making, by its classification, established the basic features of judicial law-making technology, its structure, are technical and legal means of judicial law-making and rules for their use; installed nature of judicial law-making process procedures, their features in the case-and the regulatory judicial law-making. The thesis vyokremlyuyutsya basic models of judicial law-making in the continental law: normokontrolna, competence, unifikatsiyna, human rights and procedural. The paper characterized the nature of the judicial legal precedent and legal regulations, are the possibilities and parameters of judicial law-making in Ukraine, set up proposals for the introduction and improvement of the case of judicial law-making rehlamentnoyi technologies in Ukraine.
