Essay

The thesis is a complex research of problems about guardianship as a way to ensuring, custody and protection of private non-property and property rights and interests of children and adults who are not able to realize their rights and perform duties for health reasons. The legal nature of the institution of guardianship is studied and the issues associated with determining the location of this institution in legislation system is reviewed. A number of conclusions and proposals to improve current legislation, to form prospective legislation - namely, the draft Law of Ukraine "On guardianship" are formulated.
