Hachuk K. Economic-Organizational Powers of the Bodies of Local Government

Research object: complex of public relations, accordion in the process of participation of organs of local self-government in the field of management. Research aim: development and ground of new theoretical positions of relatively organizationally-economic plenary powers of organs of local self-government, preparation of suggestions on perfection of legislation which determines these plenary powers. Research methods: formally-logical, system-structural, historical, comparatively-legal, logical-legal. Theoretical and practical value: conclusions, positions and suggestions complement the theory of economic right for relatively organizationally-economic plenary powers of participants of economic relations, assists preparation of suggestions on perfection of legislation, which determines these plenary powers, and also perfections of practice of their realization. Results drawn on in activity: to the standing committee on questions of community property of the Donetsk regional soviet; Center of research of problems of legislation and constitutional justice of economics and law faculty of the Donetsk national university at preparation of suggestions on the corresponding projects of laws of Ukraine and project Strategies reforms of local self-government in Ukraine; at teaching of the special course in the Donetsk national university. Scientific novelty The work specifies characteristic features of the legal status of the bodies of local government which determine their special place among the participants of economic relations and legal grounds for acquiring economic-organizational powers of the bodies of local government. Suggestions concerning the clarification and specification of the powers of the bodies of local government as for organization of economical activity in the municipal sector of economy and in the sphere of regulation of economical activity are given ground. The specifications of certain powers of the bodies of local government as for the provision of the legal status of the municipal property are suggested. It is specified that the forms of realisation of the powers of the bodies of local government as for organization of economical activity and its regulation are the economic-organizational (including social-municipal) obligations. The powers of the bodies concerning the provision of the legal status of the municipal property are performed in the form of property-economic obligations. Legal consequences of undue implementation of economic-organizational powers of the bodies of local government are summarized.
