Grudzur O. Criminal Legal Characteristic Provocation of Bribery.

Thesis is a complex scientific monographic research regarding issue of criminal legal characteristic provocation of bribery. A genesis of criminal responsibility legislation for provocation of bribery is investigated in the work. A comparative legal analysis of legislation of Ukraine and the legislation of foreign countries in the part of criminal responsibility for provocation of bribery is made. The main and additional compulsory object of the bribery provocation was determined, objective and subjective features of this crime, was characterized, the entry changes of the article 370 of the Criminal Code of Ukraine was proposed. An opportunity to commit bribery provocation the general subject of crime was proved. The features of separation of bribes provocation from legitimate activities aimed at identifying and documenting the facts giving or getting bribes were defined. The necessity of the of the existence of norm which excluded provocation to crime in identifying and documenting the facts giving or getting bribes, in the presence of the grounds of operational search activities was proved.
