Manzyuk V. The legal status of subjects of the tourist activity

Research object: public relations in the field of tourism. Research purpose: development and ground of suggestions on perfection of legal status of subjects of tourist activity on the basis of research of legislation of Ukraine and other countries, practices of application of the existent going near the legal adjusting of relations in the field of tourism. Research methods: comparatively legal, supervision, abstracting, inductions and deductions, axiomatic method, formal'no-yuridicheskiy, system functional. Theoretical and practical value: conclusions, positions and suggestions, are grounded by directions of perfection of legal status of subjects of tourist activity, formulate new scientific positions and suggestions to the legislation about such subjects for more effective realization by them the socio-economic functions maintenance and proceeding in the health of population fixed on them. Drawn on research results: at teaching of course the "Economic right" and the special course "issues of the day of economic right" in DVNZ the "Uzhgorodskiy national university"; taken into account Institute of legislation of Verkhovna Rada of Ukraine in the process of perfection of current legislation of Ukraine; in practical activity of Main administration on questions of European integration, external economic connections and tourism of Zakarpatskіy regional state administration. Scientific novelty: This scientific work clarifies the definition of "subjects of the tourist activity"; gives the classification of subjects of the tourist activity according to the several factors; summarizes the legal basis of the status of such subjects; proposes corresponding directions for the improvement of the legislation. The problems of opening and closure of subjects of the tourist activity have been specified. The proposals in regards to the improvement of the legal regime of property of such subjects have been grounded. The addition to the enumeration and content of rights and duties of subjects of such activity has been given. The directions of the improvement of the legal foundations of the state support of subjects of the tourist activity have been completed. The ways of the improvement of the responsibility of subjects of the tourist activity especially such aspects as bases and forms of the responsibility have been proposed. Sphere of the use: subjects of initiation of bill, subjects of tourist activity; organs of state administration, judicial bodies, management subjects, higher educational establishments.
