Zhukevych I. Dynamics of explicit and implicit legal principles.

The thesis is concerned with an important scientific task consisting in the comprehensive analysis of the concept, features, peculiarities, formation, classification, dynamics factors, interaction mechanism, reciprocal harmonization of explicit and implicit legal principles and the legal principles of the European Union. For the first time on the monographic level the peculiarities of explicit and implicit legal principles were revealed, the author's definition of the term "explicit legal principles", "implicit legal principles", "dynamics of legal principles" were worked out, the process of their formation was identified, the features of explicit and implicit legal principles were formulated. The general theoretical problems of legal principles, the issues of genesis and dynamics, the development of legal principles were further developed. The term "legal principles" was clarified. The problems of classification of explicit and implicit legal principles were analyzed. The factors of dynamics of legal principles were identified and the mechanism of their interaction was defined. The procedures on reciprocal harmonization of explicit and implicit legal principles of the European Union in Ukraine with regard to the perspectives of the European integration were suggested.
