Berdnik I. Criminal liability for falsification of election documents and documents of referendum (p.р. 1-3 art. 158 of the Criminal Code of Ukraine)

The dissertation represents the results of the comprehensive scientific study of criminal liability for falsification of election documents and documents of referendum. Based on the investigation of the grounds and conditions of criminalization social conditionality of criminal liability for falsification of election documents and documents of referendum are considered. The concepts of the following notions: "falsification", "forgery", "counterfeiting" are interpreted. The author makes the conclusion about synonymy of these notions taking into account their etymological and semantic origin and the comprehensive analysis of the rules of lawmaking technique. The problematic issues concerning the qualification of falsification of election documents are determined. Suggestions on the improvement of criminal law regarding liability for falsification of election documents and documents of referendum are formulated.
