Omelyanenko M. Criminal and Legal Protection of the Procedure of Treating the Property that is Under Arrest, Distrained or Forfeited

The thesis is focused on studying modern state and perspectives of criminal and legal maintenance of order of treating property that is under arrest, foreclosed property or property that is distrained or is due to be forfeited. Social causation of criminalization of illegal actions in relation to the abovementioned property is defined, origin of criminal law of Ukraine in relation to illegal treatment of the property that is under arrest, foreclosed property or property that is distrained or is due to be forfeited is described, a corresponding foreign experience is exposed. A deep criminal and legal analysis of corpus delicti as defined by part's 1 and 2 of the article 388 of Criminal Law of Ukraine is carried out with the account of the doctrine benefits, results of law-enforcement practice and provisions of regulative law.
