Golovatenko O. Legal regulation of property relations in the joint relationship

This thesis is devoted to the study of theoretical and practical problems relating to the content of subjective rights of the legal relation shareholding, the order of such problems, as well as forms and methods of their protection.Detection of legal specific character of shareholding objects indicates inability to spread real right structures, in particular, property rights in its classical sense to relations connected with the belonging, usage and arrangement of these objects. These legal relationships would not qualify either real right or law of contracts by their nature and occupy an independent place in the classification system. The result is the need for and unique ways to protect the violated rights of share ownership. The research results in the proposals of amendments to the existing legislation of Ukraine, recommendations of law enforcement practice subjects.
