Kotsyubynska O. Theory of State and Law: Systemic Analysis of Modern Condition and Prospects of Development.

The thesis is devoted to systemic analysis of modern conditions and prospects for the development of the theory of law and state. Trends in the origin and development of the state and law general theory as a science, traditions and innovations in the theory, differentiation and integration of scientific knowledge about a state and law are being analyzed. Distinctive features, peculiarities and place of the theory of state and law in the system of legal sciences, a subject and an object of this theory and the theory itself as a science are defined. The thesis offers the author’s approach to the formation and development of modern methods and instruments for a state and law investigations and theoretical basis for the classification of methods of the state and law theory. The factors influencing methods selection for the state and law theory cognition are being detected. The definition of a subject of the theory of state and law is formulated. The methodological mechanism for an active juridical regulation of social and legal conditions and criminality level as one of priority directions for the implementation of a state’s legal policy, criminal and legislative included, in its interrelations with a society was elaborated.
