Кovalenko S. Legal problems of valuation of property and property rights in their alienation

The work is devoted to the complex research of the problematic issues of the methodology of assessment of property and property rights. The work analyzes the content of concepts related to the procedure of evaluation, such as property, property rights, cost, disposals, the legal regime and etc. Analyzes in detail the role and the place of the stage of the legal identification of the object of evaluation, as the defining, for establishing the legal regime of the object of evaluation and motivation, with the election of the composition of the calculation procedures within the common algorithm of the estimation process. Considerable attention is paid to finding: the ratio of the categories of property, property rights to the category of property; legal and economic content of the assessment object; interdependence and interrelationship of the ideal and material aspects of property with a value. Studied modern conditions, peculiarities of legal regulation and areas of possible improvement of the legislation in the field of evaluation. Investigated some of the features of the notion of "principles for evaluation of" the National valuation standards in the context of the content of International standards of evaluation". Examined some problems of legal regulation of the valuation methodology in the context of the adaptation of National standards for evaluation to the legislation of the European union. On the basis of the research and analysis of the existing legislation in this sphere has revealed some shortcomings of the current legislation, the formulation of concrete proposals on their elimination, the proposed concept of the improvement of the essence and specifics of legal regulation of the procedure for evaluation.
