Parakuda O. Guarantee as a means of commitment's security

Thesis is devoted to complex research of private legal regulation of relationship, which arises during the issue of independent guarantees. Relationship between the parties with regard to guarantee is essentially economic and legal in form. Guarantee is a variety of financial service. Thesis determines the terms of establishing of the institute of guarantee in the civil law of Ukraine and elements, legal nature, dynamics of development of legal relationships, essence, types and termination of guarantee. The question of transformation of guarantee as the variety of suretyship into independent type of the security for the performance of obligation receives wide coverage in thesis. Sufficient deal of interest is given to the application of the institute of guarantee in international private law and legal regulation in foreign countries. In thesis the author gives the characteristic of the concepts and types of guarantee, analyses legal and doctrinal definition of guarantee and its features. Thesis deals with the analysis of grounds for guarantee's legal relations to arise. The main role is devoted to one-side settlement.
