Malskyy M. Arbitration agreement as basis for settlement of disputes in international commercial arbitration

In the dissertation, which is the first dissertational research of arbitration agreement in Ukraine, a systematic scientific research of arbitration agreement is made as well as a number of new in conceptual perspective scientific and practical points are offered. Origin and development of arbitration agreement in historical perspective are analyzed. Substantial features of arbitration agreement are determined, including its object, procedure of conclusion and substantial terms. Legal nature of arbitration agreement is characterized. Systematic analysis of Ukrainian legislation regarding arbitration agreements was performed. It was further compared with foreign legislation and proposals for improvement have been introduced.
