Ostrivniy I. The economic-law status of the private higher educational establishments

Research object: aggregate of property and organizational relations, arising up in the process of creation and functioning of private Institutes of higher. Research purpose: ground of suggestions on perfection economic of legal status of private Institutes of higher on the basis of analysis of proper normatively legal acts and theoretical generalization of economic practice of their functioning, and preparation of suggestions on bringing of concrete changes in the economic and educational legislation of Ukraine. Research methods: legalistically logical, analytic-synthetic, historical, system structural, comparatively legal. Theoretical and practical value: conclusions, suggestions and recommendations, deepen and perfect in science of economic right theoretical developments of the legal adjusting of economic relations with participation of private Institutes of higher. Research results are directed for subsequent development of theoretical problems of development in Ukraine of economic and educational legislation and practice of his realization in relation to normative regulation economic of legal status of private Institutes of higher, can serve as the article of public discussions and discussions on scientific conferences and seminars. Drawn on results in activity: Kherson economic legal institute at teaching of disciplines the "Economic right" and "Administrative law"; Executive committee of Kherson city advice; Allukrainian public association of businessmen "New Structure". Scientific novelty: In the dissertation was formulated the definition of the private higher educational establishment as a subject of economic-law; it was based the necessity of legislative ascertainment of three organization-legal forms admissible for the functioning of these educational establishments: institution that is financed by a proprietor, independent institution, nonprofit partnership. Substantiated the proposals for improving the way of creating the private higher educational establishments, legal regulation of kinds its economic activities, and its competence in the area of price formation, financial-credit relations and mutual relations with a state. Further development were received the questions that are connected with a problem of nonprofit status of the private higher educational establishments (particularly, this thesis has received a support to the effect that they must be exceptionally considered as nonprofit organizations) and legal regime of its property.
