Lysenko V. Civil-law regulation of the relations under the exchange treaty (barter contract)

The dissertation is devoted to research of problems of legal regulation of the exchange treaty (barter contract), and also to definition and theoretical justification of the directions of improvement of the existing civil legislation and legal trial of its application. The obligations arising from the exchange treaty (barter contract), their development, the nature, place in system of civil law of Ukraine are considered. It opens the contents of the civil-law exchange treaty (barter contract), it establishes features of the exchange treaty (barter contract) and its substantial differences from adjacent contracts. The analysis of the legislation and opinions of scientists concerning legal regulation of the exchange treaty (barter contract) and the problems connected with its application is carried out. The features of the conclusion, change, execution and cancellation of the exchange treaty (barter contract) are examined and defined in the dissertation. Special attention in the dissertation is given to definition and characterization of legal principles of responsibility for violation of the obligations following from the exchange treaty (barter contract). Theoretical conclusions on studied questions and practical offers on improvement of a number of standards of the existing civil legislation concerning regulation of the relations under the exchange treaty (barter contract) are formulated
