Dissertation is devoted to the concepts and characteristics of the guard and protection of ownership by notary, notary organization model as an institution of guard and protection of ownership, determine the competence of notaries, which is related to guard and protection of ownership by notary. It was proved the existence of methods to guard of ownership by notary theoretically. It was characterized basic conditions of security of ownership by notary, features of responsibility of a notary and theoretical and practical aspects of the definition "professional risk of a notary".
