Netesa N. The Criminal Responsibility for the Violation of the Rules for Protection or Use of Subsoil

The dissertation is devoted to research of criminal responsibility for the violation of the rules for protection or use of subsoil (art. 240 of the Criminal Code). The object and the subject of crime is considered. The forms and types of act connected with violation of the rules for protection or use of subsoil are determined, consequences of crime are analyzed and peculiarities of a causal link between act and consequences is studied. Special attention is paid to the study of subjective side of this crime and characteristics of the offender. The paper also deals with aggravating circumstances and the questions of punishment for this crime. On the basis of the study the author formulates proposals for the improvement of the article 240 of the Criminal Code and practices of its application.
