Yevkov A. The exhaustion of proprietary rights to the objects of intellectual property

The dissertation is dedicated to the research of the legal nature of exhausting of exclusive rights to the objects of intellectual property, grounds and peculiarities of its application. The author gives general characteristics of the exhaustion of rights to the objects of intellectual property, describes genesis of the principle of exhaustion in home and foreign civil law. The dissertation deals with the problem of revealing of legal nature of the exhaustion of exclusive rights and defines its place in the system of civil legal constructions. The characteristics of the exhaustion of exclusive rights as a limit of their exercise are given. Peculiarities of the exhaustion of rights on several objects of intellectual property are characterized. The author researches peculiarities of application of the principle of exhaustion in international trade, examines problems of settlement of territorial aspect of the exhaustion of rights in the legislation of Ukraine and its international and legal unification.
