Ganich O. Economic and Legal Responsibility of External Economic Activity Actors

Research object: aggregate of relations which arise up during realization of foreign economic activity. Research purpose: development of new scientific positions on application of economic and legal responsibility to the subjects of foreign economic activity and preparation of suggestions on perfection of legislation in the field of external economic activity on the basis of analysis of the systems of theoretical sources, normatively-legal base, practice of realization of external economic activity and judicial practice. Research methods: dialectical, system, formally-logical, analytically-synthetic, comparatively-legal. Theoretical and practical value: conclusions, positions and suggestions fill a certain blank in science of economic right in relation to economic and legal responsibility of subjects of external economic activity. Suggestion to the project of Law of Ukraine "About the currency adjusting and currency control in Ukraine" passed to the profile committee, and also taken into account at preparation of corresponding legislative acts Committee on questions of transport and connection of Verkhovna Rada of Ukraine. Results drawn on in activity: of LTD. "Аvdeevsky coker"; of LTD. "IК Mеgabudinvest"; of the Yasinovataya association of state tax inspection; by the Donetsk circuit administrative court; by the Yasinovataya inter-district office of public prosecutor of the Donetsk area; in-process of legal departmentand and in educational process of the Donetsk national technical university. Scientific novelty: The dissertation is devoted to certain peculiarities of legal regulation of economic and legal responsibility of external economic activity actors and prevention of business law violations. The research defines the notion of economic and legal responsibility in terms of external economic activity specifics, substantiates kinds and forms of EEA actors' responsibility, determines the role and place of economic and legal responsibility. Causes of encumbrance while bringing EEA actors to account have been revealed. Recommendations aiming at minimization and prevention of infringement in EEA are made.
