Yushyna Y. Infringements upon Justice Committed while Checking the Information about Crimes Committed or Being Prepared

Dissertation covers the problem of necessity of establishment of the criminal law protection of bodies and individuals that make assistance to the justice at the stage of checking the information about crimes committed or being prepared, and the problem of necessity of establishment of the same level of protection of all participants of criminal procedure. Taking into account the tasks and key characteristics of the activity, data of law application, and provisions of basic law in the sphere, some propositions for the improvement of the Criminal Code of Ukraine are formulated. In particular, it is proposed to establish criminal liability for knowingly unlawful failing to start a criminal case, close, or halt it, failing to register the information about crimes, disclosure of data of the check in question, compel to explanation. It is also proposed to consider an applicant, an interpreter and a specialist as victims of the crime provided by the art. 386 of the Criminal Code of Ukraine.
