Ganova G. Criminal liability for intentional murder committed by a group of persons by prior conspiracy.

The paper contains the legal analysis of characteristics of an offense under point 12 of Part 2 of Art. 115 of the Criminal Code of Ukraine, the issues of criminal law qualification of murder committed by a group of persons by prior conspiracy, a group of persons without prior conspiracy, accomplices with the distribution of roles, group of persons in the stock of specific and general subjects of intentional murder. The author analizes foreign and historical experience of criminal liability regulation for depriving victim of the life by several persons together, analyzes the problem of sentencing criminal groups members that have committed intentional murder. On the basis of the results obtained in the research there are developed proposals for improving the legislation of Ukraine on criminal liability and its practical application.
