Brynzanska О. Criminal responsibility for crimes against the activity of penitentiary institutions

The dissertation is a complex research of theoretical and practical regulation problems of criminal responsibility for crimes against penitentiary institutions activity. The historical growth of legislation on criminal law protection of the activity of penitentiary institutions was examined including the legislation of state's formations, a part of which Ukraine had been before, as well as criminal law development trends were considered. A foreign experience of criminal law protection of the penitentiary institutions activity, especially in post-soviet and European states, and the necessity of their application in Ukrainian criminal legislation were shown. The objective and subjective crimes characteristics according to Art.390-393 of the Criminal Code of Ukraine were analyzed. Crimes that infringe the activity of penitentiary institutions from related elements of crime such as crimes against life and health; crimes against public safety etc. were distinguished as well as they were distinguished from disciplinary offences. Specific punishments provided for by Art. 390-393 of the Criminal Code of Ukraine and their assignment have been researched. The work contains a list of suggestions concerning the improvement of the Ukrainian effective legislation.
