Essay

The thesis is devoted to the comprehensive investigation of legal facts that are the grounds for the individual labour relations' termination in Ukraine. The author investigates the constitutional guarantees of employees' rights protection against wrongful dismissal. The legislative determination of the procedure of legal facts' fixation is seen to be the integral part of these guarantees. The author offers to complete the notions of labour law with the legislative construction of labour contract suspension. The author argues the necessity of legislative determination of the list of legal facts-events that are the grounds for a labour contract termination and the distention of the list of legal consequences of the judicial admission of wrongful dismissal. The specific suggestions on the improving of the procedure of legal facts fixation that are the grounds for the individual labour relations termination, the legislative guarantees for employees terminating the labour contract due to transfer by mutual consent to another employer were made on the base of the investigation. The regulations of the termination of the temporary labour relations on employee's initiative facilitating the effective realization of the constitutional right to work were formulated.
