Essay

During the times of Independence of Ukraine the thesis has been the first complex investigation of basic problems of legal regulation in organization of work in the conditions of substantial change in the Ukrainian and world economy. The legal aspects of organization of work, their place and role of an employer and the other subjects of Labour law in such processes were investigated on basis of the latest achievements in economic and law sciences, the principles of labour legislation of Ukraine, the international legal acts about work, the experience of foreign countries were investigated. The essence of productive and other relationships connected with the organization of work is exposed; and the naturalness of their finding in the subject of Labour law is induced. The classification of proxy of the employer and the completeness of their fixation in the Labour law norms are illustrated in the work. The value of Labour contract, normative and the other legal acts in organization of work are revealed in the investigation. Special attention is focused on legal acts in organization of work which are adopted on centralize level (tariff-qualitative reference book, etc.) and on local level (regulations about structural departments, duty instructions, etc.). The legal status and the proxy of employer in the organization of work, place and role of employees and their associations in a system of organization of work in the enterprises, establishments and organizations are exposed. The basic directions in realization of the proxy of employer in organization of work connected with legal regulation in personnel work, the professional training in manufacturing, legal regulation of work time regimen, organization in setting of norms and payment of work are characterized. The causes of ineffectiveness of some norms in Labour law are distinguished and concrete suggestions in perfection of norms connected with the proxy of employer, personnel work, social activity of employer and participation of employees in manufacturing management are introduced.
