Mykhalko I. Guaranteeing of the principle of rational application of coercive measures and stimulation of law-obedient behavior of the convicts.

The dissertation is devoted to the development of the single concept of understanding of the principle of rational application of coercive measures and stimulation of law-obedient behavior of the convicts. The content and characteristic features of the branch principle are considered and based on this its definition is formulated. The content of main elements of the noted principle - coercion and stimulation is established, and their definitions are formulated in the field of correctional law. The process of implementation of this principle must satisfy the basic requirements, which are determined and its content is displayed. On the basis of the conducted research the author formulates proposals relative to guaranteeing the realization of the principle in practice.
