Ivanchenko E. Valuation of intellectual property rights objects (historical and legal research)

Presented thesis is one of the first monogram research of the domestic jurisprudence in the history of intellectual property law, international and domestic legislation for the purpose of retrospective disclosure approaches to assessment of rights on objects of intellectual property. In this investigation was carried out systematic analysis on purpose to regulate the valuation of rights to intellectual property objects, analysed and summarised the regulatory-legal base valuation of rights to objects (including the customs value) of the intellectual property in Ukraine; investigated normative-legal base of determining the customs value of goods, which include intellectual property and compliance with its international approaches. Also in the proposed criteria for the periodization of history of intellectual property law, the principles of legal regulation of relations in the sphere of intellectual property, historical forms of rights and status of the development of the legislation on intellectual property. Special attention is given to historical patterns of development of the intellectual property rights in Ukraine, its evolutionary relationship with the creation of the basic European concepts of legal protection of results of intellectual property legislation on intellectual property in the world. It is the role of international legal acts of various historical periods in the formation of State-legal system of protection of results of intellectual activities. In addition, clarification of specific achievements and fundamental flaws in the legal regulation of relations in the sphere of intellectual property, including the valuation of rights to intellectual property objects, pronounced progressive changes in the development of intellectual property in the modern period.
