Gudyma M. Consumer protection under the contract for travel services

The Candidate's dissertation is the pathbreaking study, that is devoted to the complex research problems of theoretical and practical character in civil consumer protection under the contract for travel services. The thesis analyzes the contract for travel service as a form of consumer contract, performs research of the notion and the legal status of the parties, as well as contract conceptual stage. Special attention is given to the definition and research of essence of contract. The legal status of tourists as consumers of tourism services are analyzed, revealed their rights and disclosed main content. The general principles, forms, procedures, means, and ways to protect tourists are defined. Features of civil liability of subjects of tourism, that provide tourist services, for breach of contractual obligations to consumers of tourism services are revealed, forms of such responsibility, differentiation of liability between tour operator and travel agent and the released matters are pointed out. Author's conclusions are formulated, particular suggestions improving the current legislation of Ukraine are made and substantiated to provide additional guaranties to protect the rights of tourists
