The work is devoted to the problems of the criminal responsibility for the unlawful carrying out of the searching works on the object of the archaeological heritage, destruction, demolition or damaging of the objects of the cultural heritage (art. 298 of the Criminal Code of Ukraine).The social-economic, normative and criminological factors of the criminalization of the encroachment on the objects of the cultural and archaeological heritage have been investigated. The historical review of the formation and development of the legislation on the protection of the cultural heritage has been conducted. The comparative analysis of the criminal responsibility for the encroachment on the cultural heritage has been carried out. The objective and subjective characteristics of the constituent elements of crimes, provided for by the art. 298 of the Criminal Code have been investigated. The new edition of this Article has been proposed.
