Kutsurubova-Shevchenko E. Economic-legal provision of state higher educational establishments' activity

Research object: public relations with participation of state higher educational establishments' activity. Research purpose: ground of suggestions on perfection of the economic-legal provision of activity of state Institutes of higher on the basis of analysis of corresponding normatively-legal acts and theoretical generalization of economic practice of state Institutes of higher, their separated subdivisions and scientific parks, and also preparation of suggestions in relation to harmonization of economic legislation with educational in the indicated sphere. Research methods: dialectical, specially legal, formally logical, system structural, comparatively legal, scientific and special. Theoretical and practical value: conclusions, positions and suggestions are sent to further development of theoretical problems of development in Ukraine of economic legislation and practice of his realization in relation to the economic-legal provision of activity of state Institutes of higher. Used for legal accompaniment of realization of innovative-economic activity of Scientifically technical university of Ukraine the "Kyiv polytechnic institute"; at creation and development of Statute of the Research laboratory of the "Technical electrodynamics" as the separated subdivision of Vostochnoukrainian national university the name of Vladimir Dall and in her practical activity; at teaching of educational disciplines in the Vostochnoukrainian national university of the name of Vladimir Dall. Scientific novelty: this work deals with the scientific development of the problem concerning the economic-legal provision of state higher-educational establishments' activity. Legal instruments are offered. They include: the state higher educational establishments have the rights to conduct economic activity, to handle their private property, to manage the activity of separated scientific departments, to set up state-private partnership in the sphere of higher education, to contribute to scientific achievements. The tasks and mission of state higher educational establishments and their potential are stated more precisely. Advisability to give the higher establishments the right to conduct scientific-innovative activity on the commercial basis through their separated departments on the terms of aimed usage of received incomes which must be spent on scientific activity is grounded. Alongside with the organization-legal forms of higher establishments' participation in innovative relations other types of activity stimulating them to cooperate with produces of innovative products are offered. The aim to use the treaties on the state-private partnership in the sphere of higher education is grounded. Sphere of the use: subjects of legislative initiative; scientific parks and management subjects; higher educational establishments.
