Essay

Thesis is dedicated to complex research of theoretical and practical issues of sanctions in Ukrainian labour law in the conditions of conversion to the market relations. Sanctions are investigated as measures of legal liability. The research is built on methodological principles which confess the private-law nature of labour law sanctions. This nature predetermines their essence and substance in a great deal. Substance of labour law sanctions are investigated using functional method. This method provides the analysis of functions of labour law sanctions and investigating directions of labour law sanctions impact on legal position of person. Such analysis is carried out concerning vast majority of labour law sanctions, both sanction of disciplinary (general and special) and material liability. This enabled us to illustrate the direct impact labour law sanctions on the participants of labour relations. Thesis contains the analysis of labour law sanctions concept and features, the research of their place in the system of labour law legal coercion measures. The research of the historical stages of labour law sanctions development is provided. Classification part of the research includes both an analysis of the generally accepted classification of labour law sanctions and an attempt to substantiate some theoretical issued of such scantily explored type of sanctions, as cumulative ones.
