Durneva Y. Legal status of the economic entities of the communal sector

Research object: public relations, which are folded in the process of creation, activity and stopping of subjects of management of communal sector of economy. Research purpose: development of theoretical positions and practical recommendations on perfection of legal status of subjects of management of communal sector of economy. Research methods: formal and logical, system and structural, historical, comparative and legal, logical and legal, statistical. Theoretical and practical value: conclusions, positions and suggestions deepen and perfect in science of economic right theoretical developments of legal problems which are related to the legal adjusting of activity of subjects of management of communal sector of economy and further development of corresponding legislation, and also at perfection of normative base on noted questions. Research results drawn on in activity: Center of legislative initiatives at the Donetsk regional soviet; the Communal enterprise "International airport Donetsk"; Artemivsk district soviet of the Donetsk area; To the local association of organs of local self-government of the Donetsk area; Main administration of regional development, bringing in of investments and external economic relations of Donetsk Regional State Administration. Scientific novelty: the study presents the definition of the economic entities of the communal sector and their specific features. The study also offers to change the legislation regarding the expansion of the range of the founders of the above entities. The author presents a classification of the economic entities of the communal sector by some criteria, proves the expediency of the existence of the communal joint-stock companies and communal banks and gives suggestions as for their legal status. The ways of enhancing the efficiency of corporate rights of the local communities are offered, and guarantees as for the rights to the communal property under the bankruptcy proceedings of the utility enterprises and the economic companies of communal sector are analyzed. The directions for improving the legislation in this area are well-grounded.
