The thesis analyzes the legal basis for the development of a modern democratic state in terms of determining the theoretical and methodological presuppositions of legal studies of democracy and democratic state. The role of law and legal institutions in the functioning of a democratic state is studied. The content of the principles of the legal organization of public authority in a democratic state is proved. The thesis also analyses the specificity of legal support of interaction between civil society and the state as a condition of democracy, legal guarantees of democratic pluralism in the field of public relations of power, the role of constitutionalism in the development of a democratic state. The content and specificity of ensuring the principle of legal certainty in organization and functioning of public authorities in a democratic state are shown. The dissertation establishes criteria for the classification of legal forms of government activity, justifies their systemic character. The importance of the principle of separation of powers as an institutional guarantee of democracy of the modern state is investigated, the main legal mechanisms for its security are described, and the legal mechanisms of decentralization of public power in democratic governance are analyzed. The author argues the definition of a democratic state as a specific institutionally organized system of state and local governments, which provides popular sovereignty, exercise the will of the majority of citizens, and is based on the immutable principles of law, implements a socially significant problems, contributes to achieving social consensus and protects civil society.
