Martyanova T. Discretion of Subjects of Law Enforcement Activity.

The dissertation deals with the comprehensive research of general-theoretical, moral and legal aspects of discretion of subjects of law enforcement activity. The state of the scientific study of the problem is examined within the research of doctrinal foundations of law enforcement discretion. The content and features of the general theory of law.The general-theoretical characteristic of subjects of law enforcement activity with distinguishing peculiarities of their legal status is made. The author’s view on the essence of discretion of subjects of law enforcement activity in the context of theory of state and law is proposed. Principles, factors and limits of discretion formation of subjects of law enforcement activity are outlined and analyzed. Well-known legal approaches to the conception of law enforcement acts are generalized, and their expanded classification is suggested. The problem of providing proper level of law enforcement activity in the legal state is studied, and the ways of its solution are proposed.
