Senin Y. Novation as a way of termination of the obligations under the civil law of Ukraine.

Thesis is devoted to the problems that arise with regard to the implementation of termination of the obligations by their novation. The formation and development of the legislation and the doctrine of novation are examined. There is also studied the concept and types of novations, the substance and the legal nature of the relations arising from the novations. The subject matter, content and form of substituted agreement, the order of its conclusion are analyzed. Novation and the transfer of a compensation and other related legal institutions are differentiated. The features of novation of debt in loan obligation, especially the conclusion of the substituted agreement and novation in the promissory relations are investigated. There has been formulated the theoretical conclusions from the investigated issues and practical recommendations aimed at improving the legal regulation of relations connected with the termination of the obligations by their novation.
