Polyakov V. Legal regulation of commercial activity of nonprofit organizations

Research object: complex of relations that related to economic activity of nonprofit organizations, and also grounds of her realization and stopping. Research purpose: ground of new theoretical positions, conclusions and development of the concrete offerings to of the legal adjusting economic activity of nonprofit organizations on the basis of complex analysis of domestic and foreign legislation, analysis of the systems of theoretical sources, organizational economic principles of nonprofit management. Research methods: dialectical, formal logical, analytical synthetic, comparative legal. Theoretical and practical value: conclusions, positions and suggestions fill the blanks of science of economic right at perfection of organizational, economic, legal principles of realization of economic activity nonprofit organizations. The geared-up project of Law of Ukraine "About making alteration in the Economic code and some laws of Ukraine (in relation to perfection of legal status of nonprofit organizations)" is considered and will be taken into account at preparation of corresponding legislative acts. Results drawn on in activity: to the Makiivka incorporated state tax inspection, Saint-Kazan parish of the Donetsk diocese of the Ukrainian orthodox church of city of Makiivka of the Donetsk area, Associations of joint owners of apartment house of "UYТ-2010" and at teaching of the special course in the Donetsk national university. Scientific novelty: The paper revealed the features of nonprofit organizations as entities; specified legal concept of "nonprofit economic activity", "nonprofit organization", specifies the list of non-profit organizations engaged in non-profit management, analyzed the exercise of their economic activities, the establishment and termination of non-profit organizations. The necessity of improving the legal regulation of economic activity in the nonprofit sector, which is part of the economic system. At the same time, social activities aimed nonprofit organizations to improve the welfare promotes harmonious combination of private and public interests, and thus observance of public economic order. To ensure the effective implementation of business nonprofit organizations invited to clarify property rights and obligations of these agents; developed legal approaches to the reorganization and liquidation of non-profit organizations. Sphere of the use: subjects of legislative initiative; management subjects; higher educational establishments.
