The thesis is devoted to the examination of nullity of the transactions with will defects. The notions of will, declaration of will and their correlation are determined in the research work. The types of the transactions with will defects and their place in the system of invalid transactions are distinguished. The process of will defects in the transactions is discovered. The legal consequences of the transactions that are considered to be invalid due to will defects are studied. The peculiarities of transactions nullity with incorrectly formed will are cleared up. The complex analysis of nullity of transactions, executed beyond the will of participants is made. Scientific conclusions and proposals, concerning gaps and defects elimination in legal regulation of transactions nullity with will defects are formulated.
