Essay

Dissertation is devoted to a complex problem of the theoretical principles of the legal regulation of relations on the organization and management of labor under conditions of market economy and building of the democratic, social and legal state. In it the subject composition of these relations has been highlighted, it has been proved that only worker with his unique ability to work, being impossible to separate from his personality, creates gross domestic product, material and spiritual values, promotes the country economic development. Depending on what mechanism of management and organization of labor has been proposed in the country and used at the particular enterprise, in the institution or organization, the economic power of the state, strategic way of its development and welfare of the population and also relations (democratic or totalitarian) between employees and employers have been depended. The methodological components influencing on the subject of the investigation and systematic solution of the problems of the labor law theory and practice of legislation use concerning labor in the part of the legal regulation of the relations on the management and organization of labor have been defined. On the base of the functional-legal analysis method the essential features of the relations on the management and organization of labor as part of the labor law subject have been outlined and also the general principles of their functioning have been determined. The essence and contents of the labor rationing and social partnership have been revealed. Relationships in the field of the organization and management of labor are to be grounded on the base of the rule of law, protection of the worker's rights, balance of interests of his employer and state taking into account both positive and negative consequences that brings in the social life globalization. The numerous proposals as to the conceptual tools and improvement of the legal regulation of the relations in the sphere of the organization and management of labor have been worked out.
