Skakun Y. The Preliminary Contract According To the Civil Legislation of Ukraine.

The given thesis is devoted to the problems of the current Ukrainian legislation and doctrinal provisions concerning the preliminary contract. The legal nature of the preliminary contract was considered and defined, as well as the rights and obligations of the parties in it. The place of the preliminary contract in the system of civil contracts was settled. The legal nature of jural relations arising under the preliminary contract was researched. In the paper, the peculiarities of fulfilling of the obligations set to the parties under the preliminary contract were studied. Much attention was paid to the consideration and resolution of disputes relating to the defining of legal consequences, caused by violation by parties of conditions settled in the preliminary contract. As a result of investigation made, some recommendations and suggestions for improving the legal regulation of a frame of the previous contract were provided.
