Vasilyeva V. Contract as foundation of civil legal obligation

The thesis is dedicated to the complex research of agreement and contractual obligation. There was analyzed legal nature of agreement and its place in the system of legal facts. There was made comparative analysis of concepts: "contract" and "agreement", "contract" and "contractual obligation". There were explored the terms of contract validity, order of contract conclusion, moment of contractual obligation appearance. There were studied such structural elements of contractual obligation as object, parties and maintenance. On the basis of analysis of current legislation and study of judicial practice the row of positions is formulated on the improvement of current legislation in relation to the concept of contract and obligation, terms of validity of agreement and order of its conclusion, coming from understanding of contract as a legal fact
