Essay

The dissertation is devoted to criminal-legal problems of imposing punishment under conditions commuting sentence according to criminal law of Ukraine. The legal essence of the notion commuting sentence conditions; aspects that make them distinct from the conditions aggravating punishment and main elements of the crime have been investigated. The aspects dealing with the consideration of commuting sentence conditions have been theoretically analysed. The suggestions for the improvement of criminal-legal rules providing for regulating consideration of commuting sentence conditions have been made.
