Essay

The dissertation is dedicated to the comparative analysis of legal responsibility problems as the element of the subject of the legal science of Ukraine and Poland. The problems of a research historiography, functional purpose of legal responsibility, its concept, classification, and approaches to clarification were allocated and considered as key questions during theoretical and comparative analysis. The author offers propositions concerning improvement, development, enrichment of the domestic theory of legal responsibility by separate provisions of the Polish legal researches. The concept definition of "the bases of legal responsibility" is offered. As well it is offered to introduce the model of principles of legal responsibility to the domestic general theory of the state and the law, and also research legal responsibility within the main approaches to understanding of the law. The problem questions about differentiation of preconditions, conditions and the bases of legal responsibility in a legal science of Ukraine and Poland are investigated. The problem of the bases of legal responsibility unity as a general theoretical model is considered in details; differentiation of conditions of branch types of legal responsibility is illustrated by provisions of the current legislation of Ukraine and Poland.
