Essay

The author gives a definition to a legal obligation, under which the author understands a socially conditioned need for active or passive behavior of legal relations that are structurally agreed with the subjective right of the corresponding side and because of normative definition and existing system of guaranties acquires features of imperativeness, unconditional, categorical focus on the interests of society and the individual. The necessity of using instrumental approach in highlighting balance between personal interest and subjective rights, so that interest is imagined as a potential possibility limited by objective factors of social life, focused on the use of social benefits, and subjective right as a means of both legal guarantee of individual interest, as a legal exercise of freedom of space as a phenomenon derived from the interest of the subject and as a form of mediation and its protection.
