Vikhrov S. Legal status of institutional investors

Research object: relations which are folded in the process of organization and realization by the institutional investors of investment activity at the stock market. Research purpose: development and ground of theoretical positions and suggestions on perfection of legal status of institutional investors at the stock market. Research methods: system structural, analytical synthetic, formal logical, design, sinergistical, pracseоlogical, interpretation of norms of right, comparative legal. Theoretical and practical value: conclusions, positions and suggestions complement the theory of economic right in relation to legal status of institutional investors and can be used in further theoretical researches, at perfection of legislation about investment activity at the stock market and practice of his realization. Offered changes to the article 356 of Economic code Ukraine and suggestion to the project of Law of Ukraine "About the funds of bank management" were given for consideration of Verkhovna Rada of Ukraine. Research results drawn on in activity: the Registration chamber of Chernihiv town advice in the process of registration of institutional investors; at the decision of disputes with participation of institutes of the general investing, non-state pension fund, insurance companies in the Desnyansk district court of Chernihiv; in the educational process of the Chernihiv state institute of economy and management. Scientific novelty: The paper highlighted the main types of institutional investors and found their general features, based on which the proposed definition of such investors. The basic aspects of the legal status of institutional investors by foreign law. We characterize the legal status of collective investment institutions, pension funds, insurance companies, funds of bank management as institutional investors, mainly in terms of its dynamics by identifying and analyzing basic types of economic relationships with these investors. The necessity and proposed amendments to the legislation on joint investment in the stock market. Sphere of the use: subjects of legislative initiative; institutional investors and other participants of stock market; organs of adjusting and control; higher educational establishments.
