Odegova L. The Civil-law regulation of payments using Internet banking

For the first time in the Ukrainian legal literature integral analysis of civil regulation of clearing entities civilian traffic in the Internet banking system is made. The legal nature of non-cash and e-money in this relationship is investigated. The basic concept of the basic concepts in the field of Internet banking: source control, electronic money, means of identification of customers, contractual terms, measures of responsibility, - is proposed. The subjects of civil circulation, which may be allowed to issue electronic money is discovered. Questions prospects of online banks that have no physical branches and serving customers through the Internet are discussed. Contains recommendations on the principles of risk allocation sides settlement relations using Internet banking systems. Proposals for proportional limitation of private provisions in Internet banking system are created.
