Essay

The dissertation is devoted to research of features of realization of lawmaking in conditions of transitive societies, study of lawmaking role while formation of the state of law and democratic state, and also in maintenance the supremacy of law. The analysis of lawmaking is given with a regard of theoretical and historical sources of study of essence and specificity of lawmaking, and the last achievements of a science of the theory of the state and law. Dissertation analyses the directions of influence of democratization processes in the sphere of public relations on lawmaking and development of system of the legislation, defines the types and systematizes the principles of lawmaking. The author investigates the role of a civil society in lawmaking process, demonstrates the specificity of the direct lawmaking as a basic form of participation of the citizens in lawmaking activity. The author formulates definition of the concept of lawmaking functions in conditions of transitive societies, characterizes the theoretical and practical problems of lawmaking perfection in the transitive state, studies the ways of their solving.
