Zhurova I. Execution of the exemption from punishment by bodies and agencies of the State penitentiary service of Ukraine

The author performs historical-legal analysis of the exemption from punishment. Scientifically grounded definition of the notion of exemption from punishment is formulated and its content is revealed. International experience as to the exemption from punishment is generalized which enabled to formulate a number of suggestions as to the perfection of domestic penal legislation in this direction. Practice of applying parole is analysed. The author analyses terms and conditions of exemption from punishment. Suggestions directed at the perfection of the present-day legislation are made; algorithm of exemption from punishment which is implemented in the corresponding methodological recommendations is offered.
