In the dissertation it is considered the issue of judicial defense in the constitutional and legal framework of the provision of fundamental rights and freedoms of the person and the citizen. There are analyzed the main constitutional schools of remedial court activity, support of defense of constitutional rights and freedoms of the person and citizen from the judicial authority bodies. There is opened the place, the role and the significance of the Constitutional Court of Ukraine in the constitutional and legal mechanism of the defense of rights and freedoms of the person and the citizen.
