Orlovskiy B. Theoretical and practical basis of criminal regulation the circumstances, precluding criminality in defense against publicly dangerous encroachment

The dissertation proposed the definition of the concepts "necessary defense", "grounds of necessary defense", "excess the limits of necessary defense", which are offered as appropriate to present in article 36 the Criminal Code of Ukraine. In dissertation studied the special cases of necessary defense, in defense against attacks that pose an increased danger to the public, which provided Part 5, article 36 the Criminal Code of Ukraine. This special cases author proposes to add the following - "protection from attack or threat of an armed person who attempts to commit a crime", "protect the individual against grave crime in his home".
