Essay

In this dissertation author examines the problem of the formation and development of the state activities for ensuring and protection of human and citizens' rights and freedoms. Author provided analysis of sources of the concept of ensuring and protection of human and citizens' rights and freedoms. There were determined the key elements of this concept like it's characteristics, features, content and place in the system of human and civil rights. In this research author is analyzing states' activities for ensuring and protection of human and citizens' rights and freedoms according to the requirements of modern state under the rule of law, determines their content as the mandatory need of state function in this direction. Therefore author determines the need of this function's legal forms and methods. It is concluded that this function appears as the main factor in the formation of Ukrainian statehood based on democratic principles. In the view of definitions of state functions that is observed in legal literature here was formulated the concept of the duty of state, of the mechanism for ensuring and protection of human and citizens' rights and freedoms. As the result of research was determined functionally-preventive aspect that should become the basis of functioning of state authorities. Therefore there were outlined the conditions of their effective functioning.
